SCOPE OF APPLICATION

These General Conditions of Sale (hereinafter, the General Conditions) apply to any purchase of goods or products (hereinafter, the Products) made on this Website www.offview.com, property of OFFVIEW, SL with headquarters at Calle Bosc Tancat No. 8 in Cerdanyola del Vallés, (08290) Barcelona and with NIF B-72903537.

These General Conditions may be modified at any time, so it is recommended that each time the Customer browses or purchases a Product through the Website, they review them again, as those in effect at the time of purchase will apply.


ORDERS

How to place an order?

In order to purchase any of the Products from OFFVIEW, SL, the Customer must follow these steps:

1.- To place an order you can register as a user or place an order as a guest user in this case without registering.

2.- To register as a Client you must provide a username, email address and password.

3.- To place an order, the Customer must select the Products they wish to purchase, which will be added to the Website's "shopping cart." Once all the Products have been selected, if they wish to continue with the transaction, they must click "Checkout."

4.- The Customer must provide the following information so that OFFVIEW, SL can ship the Products: full name, full address, email address, and contact telephone number. This information will be stored in OFFVIEW, SL's database and will only be visible to authorized personnel. If the Customer detects that an error occurred when entering their personal information during registration, they may modify it in the "My Account" section. In any case, the Customer may correct errors related to the personal information provided during the purchasing process by contacting customer service at +34 936 915 450 or by email at hello@offview.com. If the Customer detects an error in the order after completing the payment process, they must immediately contact customer service at the aforementioned telephone number or email address to correct the error.

5.- If available, the Customer may enter discount codes or coupons to reduce the final price of the “shopping cart.”

6.- Once the Customer has expressly accepted the General Conditions and entered the shipping information, payment may be made.

Availability and responsibility

All orders are subject to Product availability. If there are difficulties in supplying Products or due to a lack of stock, OFFVIEW, SL will refund the amount paid for them.

OFFVIEW, SL is not responsible for delays in delivery of orders or for the inability to fulfill them when the cause is due to force majeure. Force majeure events include, among other causes, accidents, strikes, fires, weather conditions, natural disasters such as storms, earthquakes, epidemics, and problems with transportation or telecommunications systems.

OFFVIEW, SL's liability in relation to any Product purchased on the Website shall be strictly limited to the purchase price of said Product.

PRICE/PAYMENT

Price of Products

The prices of the Products on the Website are indicated in euros and include taxes related to the sale of Products, including Value Added Tax (VAT). OFFVIEW, SL reserves the right to modify the price of the products and services offered through the Website. To guarantee the Customer the certainty of the price of their Products, this price will be the price in effect in the advertising at the time the order is placed.
The price of the Products does not include the cost of shipping, which will be detailed before formalizing payment.

Pay

The Client has the following payment methods available when purchasing Products on the Website:
Debit/Credit Card: To pay by debit/credit card, the Customer must follow the instructions on the sales screen, providing the card number and type, identification code, and cardholder's name. We accept the following cards: Visa, MasterCard, or American Express.

Paypal: You can complete your payment through your Paypal account to place your order. If you choose this payment method, you will be redirected to the Paypal page to log in with your username and password.

Our company uses the Stripe payment system. This platform is certified as a PCI Level 1 service provider, the strictest level of certification, creating single-use codes. For your security, Stripe will not store any of your credit or debit card information, instead, it will be stored encrypted on its system. The Products are purchased through the "BUY" button on the Website and once the General Conditions have been expressly accepted.

Value Added Tax and Invoicing

The prices on this Website include VAT only if you are a final consumer and where this tax is applicable. Our prices may change, but in such cases, changes will not affect orders for which we have already sent an order confirmation.
Likewise, OFFVIEW, SL will immediately send the Customer a confirmation of the order placed, including all its terms, to the email address provided.
The Customer will receive a paper invoice for the order along with the Products. If an electronic invoice is required, this must be indicated when placing the order.

SHIPPING

Time, shipment tracking and shipping costs

For the purposes of these General Conditions, “delivery” or the Products shall be deemed to have occurred at the time when the Customer or a third party indicated by the Customer acquires physical possession of the Products.
Each of our shipments is free and shipped through our provider to ensure they reach you in the shortest possible time.
All our packages are carefully prepared to prevent damage during transit.
It's important that you check the condition of the package before accepting delivery, and you have the right to refuse it if it doesn't arrive in good condition.
Please note that we cannot deliver to PO boxes.
We process and ship orders during our business hours, Monday through Thursday from 8:00 a.m. to 5:30 p.m., and Friday from 8:00 a.m. to 4:00 p.m.
The order will be shipped within 24 hours of receiving payment during our business hours. Delivery times may vary depending on the country you choose for delivery:
- Shipping within the European Union: 2-4 business days.
- Shipping to other countries: 6-8 business days depending on customs procedures.
As soon as we've shipped your order, you'll receive an email with the tracking number and a link to track your package.
Our provider, offers you the On Demand Delivery service, which allows you to change the delivery location or time while your package is in transit.

If for any reason OFFVIEW, SL is unable to meet the scheduled delivery date, you will be informed of this circumstance and offered the option to continue with the purchase by setting a new delivery date or cancel the order with a refund of the price paid.

PRODUCT WARRANTY

Warranty Coverage

OFFVIEW, SL products are guaranteed for a period of 3 years from delivery against any manufacturing, design, or material defects. During the warranty period, OFFVIEW, SL undertakes to exchange or refund products found to be defective through its services, as provided for in Article 118 of Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. The warranty does not include:

- Damage to the Product resulting from normal wear and tear, taking into account its nature, function and composition, nor

- Any defects in the Product that may result from faulty installation, storage, preservation or assembly, a maintenance defect, incorrect use or use that does not comply with the technical or usage specifications (failure to comply with maintenance recommendations), modifications or repairs carried out by the Customer or a third party, damage caused by external objects, external events such as accidents, impacts, fires, acts of vandalism, damage caused by water, natural or artificial light (in the event of discoloration), natural disasters or adverse weather conditions.

If you've had an accident or have a problem with your glasses, you should contact your optician so they can make the appropriate request and arrange the repair for you.

RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from the purchase of a Product within 14 calendar days without providing any justification. This period will begin to run from the date the Customer acquired physical possession of the Product. If the goods comprising the order are delivered separately, the period will begin 14 calendar days after the date the Customer acquired physical possession of the last of those Products.

The right of withdrawal cannot be invoked in the following cases:

a) The provision of services, once the service has been fully executed, when the execution has begun, with the prior express consent of the Client and with the recognition on his part that he is aware that, once the contract has been fully executed by OFFVIEW, SL, he will have lost his right of withdrawal.

b) The supply of Products or the provision of services whose price depends on fluctuations in the financial market that OFFVIEW, SL cannot control and that may occur during the withdrawal period.

c) The supply of Products made according to the Client's specifications or clearly personalized.

d) The supply of Products that may deteriorate or expire quickly.

e) The supply of sealed Products that are not suitable for return due to health protection or hygiene reasons and that have been unsealed after delivery.

f) The supply of Products that, after delivery and taking into account their nature, have been inseparably mixed with other Products.

g) The supply of alcoholic beverages whose price has been agreed upon at the time of entering into the sales contract and which cannot be delivered before 30 days, and whose real value depends on market fluctuations that OFFVIEW, SL cannot control.

h) Contracts in which the Client has specifically requested OFFVIEW, SL to visit the Client to perform urgent repair or maintenance operations, if, during that visit, OFFVIEW, SL provides additional services beyond those specifically requested by the Client or supplies Products other than the spare parts necessarily used to perform the maintenance or repair operations, the right of withdrawal must apply to such additional services or Products.

i) The supply of sealed sound or video recordings or sealed computer software that has been unsealed by the Customer after delivery.

j) The supply of daily newspapers, periodical publications or magazines, with the exception of subscription contracts for the supply of such publications.

k) Contracts concluded through public auctions.

l) The provision of accommodation services for purposes other than housing, transportation of goods, vehicle rental, food or services related to recreational activities, if the contracts provide for a specific date or period of execution.

m) The supply of digital content that is not provided on a physical medium when the execution has begun with the prior express consent of the Client, with the knowledge that he consequently loses his right of withdrawal.

Once the withdrawal has been made, OFFVIEW, SL will refund the amount paid for the Products (including shipping costs) within a maximum period of 14 calendar days from the date on which the Customer's decision to withdraw from the contract was received, using the same payment method used to make the purchase. However, the shipping costs for returning the Products will be borne by the Customer.

No refund will be issued if the Product has been used or damaged. Therefore, it must be returned in the same condition as it was delivered, including all instructions, documents, and packaging. This is without prejudice to the Customer's right to open and unpack the Product for the purpose of testing, analyzing, and evaluating it in order to make a final decision regarding its purchase.

In the event of loss, destruction, or any other cause that prevents the return of the order due to a cause attributable to the Customer, the Customer shall be liable for the market value of the service at the time of exercising the right of withdrawal, unless said value is higher than the purchase price, in which case the Customer shall be liable for the latter.

INDUSTRIAL AND INTELLECTUAL PROPERTY

All content displayed on the Website, and in particular designs, texts, graphics, images, databases, software, sounds, trademarks, logos, or any other signs susceptible to industrial and commercial use, are subject to the intellectual and industrial property rights of OFFVIEW, SL, or of third parties whose use has been duly authorized.
Under no circumstances does access to and/or use of the Website imply any waiver, transfer, license, or assignment of such rights in whole or in part, nor does it confer any right or expectation, and in particular, of alteration, exploitation, reproduction, distribution, or public communication of such content, without the prior express authorization of OFFVIEW, SL or the corresponding owners.
No link may be established to the Website from any other Website without the prior express consent of OFFVIEW, SL.

LANGUAGE

The Website, the published information, and the contract or Customer registration form will be written in Spanish, with the Customer choosing the language.

APPLICABLE LAW, JURISDICTION AND COMPETENCE

These General Conditions shall be governed by Spanish law. Any dispute arising from the application or interpretation of these General Conditions shall be resolved before the jurisdiction of the Courts and Tribunals of the city of Barcelona, waiving any other applicable jurisdiction. However, if the buyer is a consumer, any dispute that may arise between OFFVIEW, SL and the Client shall be resolved before the jurisdiction of the Courts and Tribunals of the Client's domicile or the place where the obligation is performed.

PROCESSING OF PERSONAL DATA

In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation) and Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights, the personal data provided through use of the Website will be included in a database for which OFFVIEW, SL is responsible and which complies with the technical and organizational measures intended to protect said data.
